DEFINITIONS

In these Terms and Conditions, "Casino", "Us" or "Our" refers to Kamloops Casino, a casino located, BC, Canada. The term "You" or "Your" means the person who uses Our facilities.

AGE RESTRICTION

You must be at least 19 years old (or the minimum age as required by law) to enter and use Our facilities. You may be asked to provide proof of age on request.

IDENTIFICATION AND ADMITTANCE POLICY

We reserve the right to refuse admittance or services to anyone who fails to provide proper identification, appears intoxicated, or is suspected of being underage.

RULES OF CONDUCT

You must comply with all rules and instructions displayed throughout Our premises and provided by Our staff. No person may engage in behavior that disrupts the normal operation of Our business or causes a disturbance among other patrons.

RESIDENTIAL TERMS AND CONDITIONS

a) We are licensed under the BC Gaming Control Act, 2002 to offer gaming services within Our facilities.

b) By using Our premises and/or gaming services, You acknowledge Your understanding that all games offered by Us are governed by rules set forth in the respective game's conditions of play. These rules are available for review at each game machine or upon request from Our staff.

c) All wagers placed with Our gaming equipment are subject to Our standard payout limits as displayed on individual machines or determined by specific promotions and events advertised within the premises.

d) In the event of a tie, all winning tickets will be randomly selected by electronic draw. Tied result prizes may not exceed maximum jackpot amounts established for each game machine.

ACCOUNTABILITY AND RESPONSIBILITY

a) You are responsible for Your own actions while using Our services and facilities.

b) We disclaim any responsibility for damage to personal property or loss of funds resulting from the use of gaming equipment, misuse of promotions, errors in payouts, equipment failure, technical issues or misinterpretations of rules by You or Our staff.

c) By participating in gaming activities with Us, You acknowledge that such participation is subject to and governed exclusively by British Columbia laws.

d) Any disputes arising out of these Terms and Conditions shall be resolved according to the dispute resolution procedures available under the BC Gaming Control Act, 2002.

CANCELLATIONS AND AMENDMENTS

a) We reserve the right to cancel or suspend gaming promotions at any time without prior notice.

b) Our casino staff have discretion in the management of all matters concerning gaming operations and services within Our facilities, including but not limited to enforcing house rules and supervising gameplay.

c) Changes may occur from time to time. Upon reasonable effort by Us to inform patrons, changes will be posted throughout the premises.

CLAIMS AND LIMITATIONS OF LIABILITY

a) Claims for damages or loss of money cannot exceed an amount equal to $10 million as stipulated under Section 39(2) of BC's Gaming Control Act, 2002 and shall not in any manner form a contract or provide for an award greater than such statutory limit.

b) To the fullest extent allowed by law, Our liability is limited to damages directly resulting from negligent performance on Our part. In all instances except as provided above, We will have no other responsibility beyond compensating losses under said $10 million cap.

c) Any disputes or controversies arising out of any provision set forth within these Terms and Conditions are subject to final resolution by the courts according to applicable law in effect at the time such dispute arises.

ACKNOWLEDGMENT

By entering Our premises, using gaming services and/or participating in promotions, You acknowledge that:

a) You have read, understand and agree to be bound by all terms and conditions set forth above;

b) You will comply with house rules as well as any other regulations displayed throughout Our facilities or communicated through electronic channels.

c) In case of breach or non-compliance, Your gaming privileges may be terminated at the discretion of management without notice.

d) Upon entering into this agreement by accepting these terms and conditions, you agree that any disputes arising out of it will be resolved in accordance with the BC Gaming Control Act, 2002.

GOVERNING LAW AND JURISDICTION

These Terms and Conditions are governed and enforced exclusively under British Columbia law as contained within the BC Gaming Control Act, 2002. Any dispute shall be subject to final determination by a court of competent jurisdiction in Kamloops or a nearby city approved for such actions.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between You and Us with respect to use of Our gaming facilities and services. This includes any prior correspondence, conversations, and oral agreements that are hereby cancelled.

MODIFICATIONS AND CHANGES

Kamloops Casino reserves its right at all times to modify or amend these Terms and Conditions in order to comply with applicable laws and regulations; it may be done without providing advance notification.

CHANGING THE TERMS

We can make any changes we think are needed, like adding a new promotion or changing one of the rules.

CHANGES TO GAMES

The games played on our gaming machines or provided by other providers within Our premises will change over time to comply with updated regulatory standards for fair gaming practices in British Columbia as implemented through amended versions of Our software systems from suppliers licensed under applicable Gaming Control Acts, including but not limited to iGaming regulation and monitoring tools.

GAME RESPONSIBILITY

All wagers placed using electronic means are considered valid unless we have evidence showing a clear breach of security or unauthorized access that led to unauthorized transfers.

WARRANTY EXCLUSION

Any express warranty contained in these Terms is hereby disclaimed, except as set forth under applicable British Columbia legislation governing consumer protection rights for gaming facilities and services operated by Us within the Province's territory.

CONSENT

By using Our premises or engaging with our products/services, You consent to collection of data concerning gameplay history; however, that information must be kept confidential in accordance with applicable federal/BC regulations.

APPLICABLE STATUTES AND REGULATIONS

These terms shall comply with all provincial laws regarding gaming and wagering activities under the B.C Gaming Control Act 2002 as amended by any subsequent legislation passed during or before the life of this contract, which must be followed consistently throughout their term in existence hereunder.

ENTIRE AGREEMENT AND UNDERSTANDING

This Terms and Conditions document constitutes an entire understanding between You (or Your estate) and Us with respect to use of Our gaming facilities/services; prior oral discussions are hereby declared as effectively canceled without prejudice by signing below acknowledging that these terms prevail over any conflicting agreements made previously in relation thereto.

GOVERNING LAW

All matters related to or connected directly to this document will be subject solely to British Columbia jurisdiction according to principles outlined within Section 39 (2)(a) of BC Gaming Control Act, 2002 where such disputes cannot be settled amicably.
